Terms of Service

Aviate is operated by KLL Studios LLC, 9412 Civic Way, Apt 210, Prospect, KY 40059, United States. "Aviate," "we," "our," and "us" refer to KLL Studios LLC.
Acceptance and eligibility
By downloading, installing, creating an account, accepting the in-app user-generated-content rules, or using Aviate, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service. You must be at least 13. If you are under the age of legal majority where you live, you represent that a parent or guardian permits your use.
The service
Aviate provides flight tracking, boarding-pass storage and scanning, trips, checklists, parking tools, notifications, airport and map information, Wear OS features, airline loyalty connections, an optional Samsung Wallet boarding-pass transfer where available, public flight sharing, public profiles, route and travel statistics, groups, forms, support reports, and related free or paid features. Features, data sources, availability, and tier placement may change.
Group data is encrypted in transit and at rest, with Aviate's servers facilitating member access and key distribution. It is not represented as end-to-end encrypted. Only share information that every current group member may view.
Flight status, airport, weather, map, radio, connectivity, prediction, and similar information can be delayed, incomplete, or wrong. Confirm safety-critical and time-sensitive information with the airline, airport, government, or other authoritative source.
Accounts and security
Provide accurate account information, protect your device and credentials, and notify us promptly of unauthorized access. You are responsible for activity under your account. You may not sell, transfer, share, automate access to, probe, disrupt, reverse engineer except where law expressly permits, or use another person's account without authorization.
Airline Connections
If Airline Connections is enabled for your Pro account, you may choose to sign in to a supported airline or loyalty program through the airline's website in Aviate's in-app browser. Aviate does not receive or store the password you enter there, but the feature temporarily sends the airline access token or selected loyalty responses described in the Privacy Policy to Aviate so it can retrieve and normalize your loyalty and trip data.
Aviate is not affiliated with, endorsed by, or partnered with the supported airlines or loyalty programs. You authorize the limited requests needed for the connection and are responsible for complying with the airline's terms. Balances, status, and trip data can be delayed, incomplete, or inaccurate. Disconnecting removes Aviate's normalized connection record and app cache; it does not delete the airline account or necessarily end the airline website session.
LiveATC
The optional Pro LiveATC feature loads and reformats LiveATC.net pages and audio-player content in Aviate's in-app browser. LiveATC is an independent third party and is not affiliated with Aviate. Its content is subject to LiveATC's terms, privacy practices, availability, advertising, and regional restrictions. Do not rely on a feed for an operational or safety decision. You are responsible for ensuring that your use is lawful where you are located.
Samsung Wallet
Where Add to Samsung Wallet is available, selecting it authorizes Aviate to construct an encrypted, signed wallet card from the eligible boarding pass and transfer it to Samsung at your direction. Samsung determines whether it accepts, displays, updates, or removes the card under its own terms. Delete a saved card through Samsung Wallet; deleting your Aviate account does not itself remove a card already held by Samsung. Aviate's temporary and legacy cache handling is described in the Privacy Policy.
User-generated content rules
Public profile names, display names, public routes/statistics, group names/descriptions, invitations, and other content submitted for display or interaction are user-generated content ("UGC"). Before creating or interacting with UGC, Aviate may require acceptance of the current UGC rules.
You must have the rights and permissions needed for content you submit. You must not create, upload, publish, invite, link, or direct others to content that:
- sexually exploits or endangers a child, sexualizes minors, or facilitates grooming;
- contains non-consensual intimate imagery, sexual exploitation, or prohibited explicit sexual content;
- promotes terrorism, violent extremism, credible threats, violence, self-harm, or dangerous acts;
- attacks or dehumanizes people based on race, ethnicity, nationality, religion, disability, sex, gender, sexual orientation, age, veteran status, or another protected characteristic;
- harasses, stalks, bullies, blackmails, or targets another person for abuse;
- impersonates a person or organization, misrepresents affiliation, or uses deceptive identity information;
- exposes private or sensitive personal information, credentials, precise location, travel documents, confirmation codes, or financial information without authorization;
- infringes copyright, trademark, privacy, publicity, or other rights;
- facilitates illegal goods, fraud, malware, spam, manipulation, unauthorized access, or other unlawful activity; or
- evades blocks, suspensions, moderation decisions, rate limits, or safety controls.
Do not include passwords, payment-card details, access tokens, unrelated private communications, or another person's sensitive information in public content, forms, or bug reports.
Reporting, blocking, and moderation
Users can report a public profile, user, or group through Aviate's reporting control and can block users. Blocking is intended to prevent covered future invitations, sharing, profile interactions, and visibility, but cannot erase information someone already lawfully received or guarantee no encounter outside Aviate.
We review reports and may preserve relevant evidence, limit distribution, remove a group, disable a public profile, suspend UGC participation, restrict features, or suspend/terminate an account. We may act without advance notice where reasonably necessary for safety, law, service integrity, or repeated violations. Reports made in bad faith or to harass others also violate these Terms. Contact [email protected] to request review of a moderation decision; provide the account and decision details, but do not resend prohibited content unnecessarily.
License to user content
You retain ownership of your content. You grant Aviate a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, format, and display it only as needed to operate, secure, moderate, and improve the chosen feature. The license ends when the content is deleted from active systems, subject to legal preservation and time-limited backups described in the Privacy Policy.
Subscriptions and purchases
Google Play processes Android purchases. Prices, billing periods, trials, taxes, renewal, and refund eligibility are shown before purchase and governed by Google Play and applicable law. Recurring subscriptions renew unless canceled through Google Play. Deleting the Aviate account does not automatically cancel a Google Play subscription, and canceling a subscription does not delete the Aviate account. Follow both sets of instructions on the Account deletion page when you want both outcomes.
Third-party services
Google Sign-In, Google Play, Firebase, Samsung Wallet, LiveATC, supported airline and loyalty websites, Resend, Amazon SES, Cloudflare Turnstile, maps, travel data, weather, and external links may be governed by third-party terms. Aviate is not responsible for third-party services or their independent acts. You authorize the limited data exchange needed when you choose a connected feature.
Intellectual property
The Aviate service, software, designs, marks, and non-user content are owned by KLL Studios LLC or licensed to us. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. No rights are granted except those expressly stated.
Health disclaimer
Jet-lag and sleep-timing guidance is general educational travel information. Aviate is not a medical device and does not diagnose, treat, cure, or prevent disease; consult a qualified professional. Do not delay professional care or disregard medical advice because of information in Aviate.
Suspension, deletion, and survival
You may delete your account as described at aviate.app/account/delete. We may restrict or terminate access for material or repeated violations, fraud, security risk, legal requirements, harm to users, or discontinuation of the service. Provisions that by their nature should survive termination do survive, including intellectual property, disclaimers, liability limits, and dispute terms.
Disclaimers
TO THE EXTENT PERMITTED BY LAW, AVIATE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT UNINTERRUPTED SERVICE, ERROR-FREE DATA, OR THAT A NOTIFICATION WILL ARRIVE.
Limitation of liability
TO THE EXTENT PERMITTED BY LAW, KLL STUDIOS LLC AND ITS PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS OR DATA, MISSED FLIGHTS, TRAVEL COSTS, OR RELIANCE ON DELAYED OR INACCURATE INFORMATION. OUR TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID AVIATE IN THE 12 MONTHS BEFORE THE EVENT. Some jurisdictions do not allow every exclusion, so these limits apply only as permitted.
Indemnity
To the extent permitted by law, you agree to defend and indemnify KLL Studios LLC from third-party claims arising from your unlawful use, your UGC, or your material violation of these Terms. This does not apply where prohibited or to the extent a claim results from our own conduct.
Governing law and disputes
These Terms are governed by Kentucky law, without regard to conflict-of-law principles, except that mandatory consumer protections in your location still apply. Before filing a non-urgent claim, contact [email protected] and allow 30 days for an informal resolution. Claims that cannot be resolved may be brought in a court with lawful jurisdiction. Nothing here limits rights that cannot legally be waived.
Changes and contact
We may update these Terms. We will change the date above and provide additional notice when required. Continued use after an effective update means acceptance where permitted; if you do not agree, stop using the service. Questions: [email protected].
